1. Agreement to Terms

By downloading, installing, or using Viewer for Trello ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the App.

2. Description of Service

Viewer for Trello is a tvOS application that enables you to display and monitor Trello boards on Apple TV devices. The App provides:

  • Read-only access to Trello boards via secure authentication
  • Real-time synchronization of board updates
  • Filtering capabilities by lists, labels, and members
  • QR code-based authentication system
  • Optional premium features available through in-app purchase

3. Third-Party Disclaimer

Important Notice: Viewer for Trello is an independent third-party application. We are not affiliated with, endorsed by, or sponsored by Atlassian Corporation Plc or Trello. Trello is a trademark of Atlassian Corporation Plc.

The App accesses Trello services through their official API under the terms of Trello's API Terms of Use. Your use of Trello remains subject to Trello's own Terms of Service.

4. User Accounts and Authentication

4.1 Account Requirements

  • You must have a valid Trello account to use this App
  • You are responsible for maintaining the confidentiality of your authentication credentials
  • You must notify us immediately of any unauthorized use of your account

4.2 QR Code Authentication

  • Authentication is performed through a secure QR code system
  • QR codes are time-limited and single-use for security purposes
  • You must have access to a device capable of scanning QR codes

4.3 Account Security

  • We recommend regular review of connected devices in your Trello account settings
  • You can revoke App access at any time through Trello's account settings

5. Acceptable Use Policy

You agree NOT to use the App to:

  • Violate any laws or regulations
  • Infringe upon intellectual property rights
  • Attempt to gain unauthorized access to any systems or data
  • Interfere with or disrupt the App's functionality
  • Use the App for any commercial purpose without authorization
  • Share authentication credentials or QR codes with unauthorized parties
  • Attempt to reverse engineer, decompile, or disassemble the App

6. Premium Features and Subscriptions

6.1 In-App Purchases

  • Premium features are available through Apple's In-App Purchase system
  • All payments are processed by Apple according to their terms
  • Subscription prices are displayed in the App Store and within the App

6.2 Subscription Terms

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions through your Apple ID account settings

6.3 Refunds

  • Refund requests must be directed to Apple through their support channels
  • We cannot directly process refunds for App Store purchases

7. Intellectual Property Rights

7.1 Our Rights

  • The App and its original content, features, and functionality are owned by Appic Ltd
  • The App is protected by copyright, trademark, and other intellectual property laws
  • Our trademarks and trade dress may not be used without our prior written permission

7.2 Your Rights

  • You retain all rights to your Trello content
  • We claim no ownership over your boards, cards, or other Trello data
  • Your content remains subject to Trello's terms of service

7.3 Trello Content

  • Trello and all related logos are trademarks of Atlassian Corporation Plc
  • Your use of Trello content through our App must comply with Trello's terms

8. Privacy and Data Protection

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Limitations

9.1 Service Availability

  • The App is provided "as is" and "as available"
  • We do not guarantee uninterrupted or error-free operation
  • Service may be suspended for maintenance, updates, or circumstances beyond our control

9.2 Third-Party Service Dependencies

  • The App's functionality depends on Trello's API availability
  • We are not responsible for Trello service interruptions or changes
  • Trello may modify or discontinue their API at any time

9.3 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT SHALL APPIC LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
  • THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH THE CLAIM IS BASED

11. Indemnification

You agree to indemnify, defend, and hold harmless Appic Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or data

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes:

  • We will update the "Last Updated" date
  • We will provide notice through the App or other appropriate means
  • Your continued use after changes constitutes acceptance of the modified Terms

13. Termination

13.1 Your Rights

  • You may stop using the App at any time
  • You may delete the App from your device at any time
  • You may revoke the App's access to your Trello account at any time

13.2 Our Rights

We may terminate or suspend your access immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Actions that harm other users or our services
  • At our sole discretion for any reason

13.3 Effect of Termination

  • Upon termination, your right to use the App ceases immediately
  • All provisions that should survive termination shall survive
  • Termination does not entitle you to refunds for any purchases

14. Apple-Specific Terms

14.1 Apple's Role

  • Apple has no obligation to furnish maintenance or support services
  • Apple has no warranty obligation with respect to the App
  • Apple is not responsible for addressing any claims relating to the App

14.2 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

14.3 Export Regulations

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us at hello@appicltd.com.

16. General Provisions

16.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Appic Ltd regarding the App.

16.2 Severability

If any provision is found unenforceable, the remaining provisions shall continue in full effect.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
